ProBikeKit Terms & Conditions

ProBikeKit provides access to the ProBikeKit websites (the 'Websites') and sell our products to you subject to these terms and conditions (the 'Conditions') set out in this document. This is a formal agreement. However, our Conditions are fairly standard and designed to enhance your experience with us and make it as easy and secure as possible.

The Conditions apply to the use of the ProBikeKit Websites. By placing an order with us and/or registering on our Websites you are agreeing to accept our Conditions.

Please note, we may change these Conditions at any time and it is up to you to check our Conditions regularly before ordering products in case there are any changes. We will post any changes in the Conditions on the Websites.

ProBikeKit is the trading name of The Hut.com Limited (Company Number 05016020) a company registered in England and Wales and whose registered office is at Meridian House, Gadbrook Park, Rudheath, Cheshire, CW9 7RA. Your contract for purchases and marketing communications from ProBikeKit will be made under these Conditions which will apply between you and The Hut.com Limited. Prior to 1 January 2014, ProBikeKit was Bike Kit Limited (Company Number 08317188) a company registered in England and Wales and whose registered office is at Meridian House, Gadbrook Park, Rudheath, Cheshire, CW9 7RA.

By using our Websites and/or placing an order for goods you confirm your agreement to the Conditions, including our Delivery Options, our Security and Privacy Policy and the Returns and Exchanges Procedures.

Nothing in our Conditions affects your statutory rights.

You are responsible for ensuring the accuracy of information in your order and your billing and delivery details. You warrant that all details provided in the order for the purpose of purchasing the goods are correct, that you are authorised to use the credit or debit card you are using and that there are sufficient funds and/or sufficient unused limit available to cover the cost of the goods.

It is your responsibility to ensure you have selected the correct preferences which govern the country you are ordering from and the currency in which our prices are displayed as well as the country to which your order will be dispatched.

All orders are subject to our acceptance.

Certain items available on our Websites, such as specialist tools incorporating knives, may only be ordered by customers over eighteen years old. Such items are indicated on our Websites. When you order such items you warrant that you are over eighteen years old.

We provide the specifications for products listed on our Websites and you are responsible for ensuring that the products you order meet your requirements and adhere to any local regulations for import or use in your country.

When you have placed an order to purchase a product from us, we will send you an email confirming receipt of your order and containing the details of your order.

We will send you a further email confirming that we have dispatched the products to you. No contract for the sale of any product will exist between you and us until we accept your order by dispatching the products to you.

The emails confirming receipt of your order and confirming dispatch will be sent to the email address given in your order and will detail products ordered, payment method, cost (including any VAT applied on orders in the European Union and delivery and handling charges). You should check all the details in these emails are correct and contact us as soon as possible if any details are incorrect. If your order has not been accepted, you will receive an email from us notifying you.

You are responsible for ensuring the accuracy of information in your order and your billing and delivery details. You warrant that all details provided in the order for the purpose of purchasing the goods are correct, that you are authorised.

We hold the vast majority of the goods listed on our Websites in stock. Our Websites will indicate whether products are in stock at the time of your order. We do not place items on back order. For certain items described below we may also offer you the option of ordering the product in advance.

Deposit Items

Certain high value items are not readily available from stock and require a production order to be placed on the supplier. Such items are identified on our Websites as Preorder items. In order to secure supply of these items, prior to confirmation of your order we will require you to pay a deposit of the total order value. When ordering such items you agree that the expected delivery date can be variable. We will keep you informed by email of expected delivery timeswhich in certain circumstances may be up to approximately twelve weeks.

Product Launches

We are committed to providing our customers access to new and seasonal cycling equipment and accessories as soon as they become available. There is often strong demand for such products and from time to time we enable customers to order such items in advance of their general market availability in order that they can secure delivery as soon as the product becomes available. When you order such items we will not charge your card until we have received the items in to stock ready for dispatch. In placing your order you confirm that the expected delivery date of such items may exceed 30 days.

The price of the products will be the price quoted on the Websites at the date the order is received in the currency you have selected. The price will include VAT for those customers in the European Union and delivery charges unless specified otherwise. The value of any Reward Points and/or Promotional Discounts claimed and validated in your order will be deducted from the price payable on your order and will be shown in the checkout.

We review our prices and discounts offered against recommended retail prices regularly and our prices will change periodically. Discounts shown on our Websites against recommended retail prices may vary from time to time. Any increases in discounts after the date of your order will not be applied to your order retrospectively.

When we provide any products to you under these Conditions, payment will be charged to the credit or debit card account provided by you during checkout. Any deposit paid will be deducted from the final payment on any order. We accept credit and debit card payments by Visa and Mastercard.

By placing an order, you consent to payment being charged to your credit or debit card account as provided on the order. All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

We may from time to time offer Promotional Discount Codes which may apply in respect of any or certain specified purchases made though the Websites. The conditions of use relating to Promotional Discount Codes will be specified at the time of issue. A Promotional Discount Code may only be used once and no more than one Promotional Discount Code can be applied to any order. Promotional Discount Codes must be claimed on submission of your order and cannot be applied retrospectively.

Gift Cards may be used to purchase products from our Websites up to the value of the Gift Card. In the event that the value of an order is less than the value of the Gift card, the remaining balance on the Gift Card may be used on future orders. Gift Cards are only valid for 3 years from the date of receipt.

By encouraging active participation by individual users in the communal content in our Websites, we believe we will build the content of the Websites to enhance the experience for all of our users. However, we recognise that clear standards of conduct should be explained and enforced, to ensure that the actions of small numbers of disruptive users are not allowed to devalue community content accessible to all of our users. This section of the Conditions sets out the bases under which our community participation is managed.

Registration

We reserve the right to close accounts if any user is seen to be using proxy IPs(Internet Protocol addresses) in order to attempt to hide the use of multiple accounts or disrupts any of our services in any way. If you use multiple logins for the purpose of disrupting the community you may have action taken against all of your accounts.

Submission Of Material

We love to hear your views, and encourage all users to participate by posting reviews,comments, and other content; send communications; and submit suggestions, ideas, comments, questions, or other information.

By submitting any material to us, you automatically grant us the royalty-free, perpetual, exclusive right and license to use, reproduce, modify, edit, adapt, publish, translate, create derivative works from, distribute, perform and display such material (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. You also acknowledge that we are not obliged to publish any material submitted by you on our Websites. You warrant that any content you submit is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of 'spam.' You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any content.

We advise that you never reveal any personal information about yourself or anyone else in any contribution. Our moderators routinely review content submitted by users, but it's simply not possible to review everything that's posted on the Websites. If you believe that any user content on the Websites contains a defamatory statement, please notify us immediately. We will investigate any such incidents and remove content we believe is defamatory.

Failure To Comply

If you fail to abide by these Conditions relating to the ProBikeKit Community you maybe sent an email which informs you why your contribution has been refused or edited. This email will also include a warning that continuing to break the rules may result in action being taken against your account or accounts.

This action may include any content posted by you being checked before being allowed to go on the site or a temporary or permanent suspension of your ability to participate in any or all areas of the Websites.

We reserve the right to delete any contribution, or take action against any account, at any time, for any reason. If you do not want to grant us the permission set out above in these Conditions, please do not submit or share your contribution on the Websites.

Limitation Of Liabilities: Websites

We will attempt to ensure that the information available on the Websites at any time is accurate. However, we will not be held liable for any errors or omissions. We will use all reasonable endeavours to correct errors and omissions as quickly as practicable after becoming aware or being notified of these. We do not accept liability for any errors and/or omissions contained in our Websites and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice.

All drawings, descriptive matter and specifications of the goods on the Websites are for the sole purpose of giving an approximate description of the goods. We make every effort to ensure that images of products on our Websites are accurate. However we are not liable for any slight differences in colour between the goods and the images shown on our Websites.

We may also change, suspend or discontinue any aspect of the Websites, including the availability of any features, information, database or content or restrict access to parts or all of the Websites without notice or liability.

We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

Limitation Of Liability: General

We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events. If our service to you is affected in such circumstances, we will notify you as soon as possible.

Except in respect of death or personal injury caused by our negligence, we will not be liable to you, for any loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims, which arise out of or in connection with the use of the Websites and/or the supply of goods.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to products purchased from our Websites. This does not affect your ability to cancel your contract or return product in accordance with our Returns and Exchanges Procedures or your statutory rights as a consumer.

We have taken every measure to prevent Internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot beheld liable in the extremely unlikely event of a breach in our secure computer servers.

The copyright in the material contained on and in the Websites and any trademarks and brands included in that material belong to Bike Kit Limited or its licensors.

You may download or copy content displayed on the Websites only for personal non-commercial purposes. You are not permitted to copy, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in anyway the content of the Websites for any other purpose whatsoever without our prior written permission.

ProBikeKit trade marks belong to Bike Kit Limited. No licence or consent is granted to you to use these marks in any way, and you agree not to use these marks or any marks which are colourably similar without our written permission.

If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Conditions and the remainder of the provision in question will survive.

These Conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English courts.

Why Recycle?

Unwanted electrical equipment is the UKs fastest growing type of waste.

Many electrical items can be repaired or recycled, saving natural resources and the environment. If you do not recycle, electrical equipment will end up in landfill where hazardous substances will leak out and cause soil and water contamination, harming wildlife and also human health.

Under theWaste Battery Regulations, Probikekit are now offering a take back scheme for all portable waste batteries. You can return your waste batteries to our business premises in person. (please do not post). Alternatively, you can find your local waste portable battery recycling facility at www.recyclenow.com

Most supermarkets and shops that sell batteries will have collection bins for used batteries, and some town halls, libraries or schools may also set up collection points. End-users may find stores in their local area more accessible.
